By accessing smoovedrums.com, purchasing products, or using Smoove Drums LLC services, customers agree to these Terms of Service and the High-Tension Safety Waiver.
High-Tension Safety Waiver
Marching percussion equipment, including high-tension snare heads, Kevlar/Aramid drumheads, tension rods, die-cast hoops, lugs, strainers, and marching carriers, is subject to extreme mechanical forces and tension.
Customers acknowledge that high-tension drum tuning and carrier installation carry inherent risks, including structural metal fatigue, stripped threads, mechanical snapping, lug failure, and personal injury or property damage caused by flying debris or structural hardware collapse.
Smoove Drums products are intended for professional use by qualified drum technicians, band directors, and experienced performers. Customers assume responsibility for proper installation, torque limits, maintenance, and usage.
Smoove Drums LLC is not liable for structural failures, rim warpage, shell collapse, snapped tension rods, or bodily injury resulting from overtightening, improper installation, negligence, or normal wear and tear during field performance or practice.
Retailer & Supplier Terms
Smoove Drums LLC acts as an independent e-commerce retailer and distributor.
Unless explicitly stated under a branded Smoove Drums warranty, all products are supplied AS IS and AS AVAILABLE.
Product specifications, thread pitch tolerances, and metal alloys may vary by approved international manufacturing partner. Minor cosmetic variations, surface scratches, or material finishes do not constitute a product defect.
Shipping & Fulfillment
Delivery estimates shown on smoovedrums.com or through tracking notifications are approximations and are not guaranteed delivery dates.
Orders may be dispatched from domestic distribution centers or international logistics hubs. Smoove Drums LLC is not responsible for delays caused by customs clearance, border inspections, or third-party logistics carriers.
Customers are responsible for providing complete and accurate shipping details. Smoove Drums LLC is not liable for orders delivered to incorrect addresses provided during checkout.
Returns
Unused hardware, drumheads, and carriers in original packaging may be returned within 30 days of delivery, subject to a restocking fee and return shipping costs.
Used or tuned drumheads, modified hardware, stripped tension rods, or items damaged due to improper installation are strictly non-refundable.
Liability Cap
To the maximum extent permitted by applicable law, Smoove Drums LLC, its officers, directors, employees, agents, and suppliers shall not be liable for indirect, incidental, special, consequential, or punitive damages.
The total aggregate liability of Smoove Drums LLC for any claim arising out of or relating to a purchase shall not exceed the total amount actually paid for the specific product in question.
Legal Notices
These Terms of Service are governed by the laws of the state in which Smoove Drums LLC is registered, without regard to conflict of law principles.
